Payment Method:

  • PayPal (for international customers)

  • Razorpay (for Indian customers)

Cash on delivery (COD) orders are not accepted.

Price Changes and Service Modification:

We shall not be liable for any indirect, consequential, or punitive damages arising from copyright disputes related to client-provided reference materials.

Indemnification:

You agree to indemnify, defend, and hold harmless AMAANSA Fine Arts Studio and our parent, subsidiaries, affiliates, partners, officers, directors, agents, contractors, licensors, service providers, subcontractors, suppliers, interns, and employees, harmless from any claim or demand, including reasonable attorneys’ fees, made by any third party due to or arising out of your breach of these Terms of Service or the documents they incorporate by reference, or your violation of any law or the rights of a third party.

Copyright-Specific Indemnification:

You specifically agree to indemnify, defend, and hold harmless AMAANSA Fine Arts Studio from any claims, damages, costs, or legal actions arising from:

  • Copyright infringement related to any images, photographs, or reference materials you provide

  • Any third-party intellectual property claims related to your commissioned artwork

  • Unauthorized use of copyrighted materials in reference images you submit

  • Any misrepresentation regarding your ownership or rights to provided materials

Copyright assignment and commissioned works

Ownership of Commissioned Artworks:

  • All commissioned artworks created by AMAANSA Fine Arts Studio remain the intellectual property of the artist until full payment is received.

  • Upon full payment, clients receive ownership of the physical artwork and limited rights for personal use.

  • Third-Party Intellectual Property
    Ownership or intellectual-property rights in an AMAANSA-created artwork do not transfer, include, or affect any intellectual-property rights belonging to third parties whose products, trademarks, brand names, logos, photographs, designs, or other materials may appear in reference, illustrative, compatibility, or promotional materials.
    AMAANSA Fine Arts Studio does not claim ownership of any third-party trademarks, logos, brand names, product designs, photographs, watch designs, or other intellectual property belonging to their respective owners.

  • AMAANSA Fine Arts Studio retains the right to photograph, display, and use images of completed works for portfolio, marketing, and promotional purposes.

  • Confidential Commission Add-on
    For customers who prefer their commissioned artwork to remain private, AMAANSA Fine Arts Studio offers a Confidential Commission Add-on for an additional fee.
    When this add-on is purchased, AMAANSA will not publicly display, publish, post, advertise, or otherwise use photographs or visual documentation of the customer's commissioned artwork or the customer's supplied reference photographs for AMAANSA's portfolio, website, social-media, advertising, promotional material, or other public-facing marketing purposes.
    The commissioned artwork will remain available for the customer through the normal order and delivery process, and AMAANSA may retain limited internal records or documentation where reasonably necessary for order fulfilment, quality control, customer support, accounting, legal compliance, dispute resolution, or other legitimate business purposes.
    This add-on does not transfer copyright or ownership of any third-party photograph, trademark, logo, brand, or other third-party intellectual property to the customer or AMAANSA.
    The confidentiality restriction applies to AMAANSA's public-facing use and display of the commissioned artwork and related customer-supplied reference material. It does not prevent AMAANSA from complying with a legal obligation, responding to a lawful request from a government or judicial authority, or retaining information where retention is required or permitted by applicable law.
    The Confidential Commission Add-on applies only where the add-on has been expressly purchased and paid for as part of the customer's order.

Copyright Assignment for Reference Materials:

  • By providing photographs or images for commissioned work, clients grant AMAANSA Fine Arts Studio a non-exclusive license to use such materials solely for creating the commissioned artwork.

  • This license terminates upon completion and delivery of the commissioned work, except for portfolio documentation purposes.

Copyright Compliance Procedures:

  • AMAANSA Fine Arts Studio reserves the right to refuse commissions that may pose copyright risks

  • Alternative reference materials may be suggested to ensure compliance

  • Existing commissions may be modified or cancelled if copyright issues arise

  • Clients will be notified promptly of any copyright concerns

Client warranties and representations

Image Ownership Warranties:
Clients warrant and represent that:

  • They own all rights to any photographs or images provided as reference materials

  • Any provided materials are either original works, properly licensed, or in the public domain

  • They have obtained all necessary permissions for any third-party images submitted

  • No provided materials infringe upon any third-party copyrights, trademarks, or other intellectual property rights

Breach of Warranties:
If any client warranty proves false, the client agrees to:

  • Immediately notify AMAANSA Fine Arts Studio of any potential copyright issues

  • Provide alternative reference materials or accept modifications to avoid infringement

  • Bear all costs and damages resulting from such breach

Derivative Works and artistic interpretation

Nature of Commissioned Artworks:

  • All commissioned works are original artistic interpretations and derivative works created by AMAANSA Fine Arts Studio

  • The artist reserves the right to make reasonable artistic modifications to ensure legal compliance and artistic integrity

  • Clients acknowledge that commissioned works are transformative artistic creations, not direct reproductions

Artistry in Faith Collection - Terms:
For religious and devotional artworks:

  • AMAANSA Fine Arts Studio creates original interpretations based on traditional iconography and public domain sources

  • Clients acknowledge that reference images from social media or internet sources may pose copyright risks

  • AMAANSA Fine Arts Studio reserves the right to decline commissions that may infringe third-party copyrights

  • Alternative reference materials may be suggested to ensure legal compliance

Watch Dial Commissions — Specific Terms

1. Scope of the Watch-Dial Offering

AMAANSA Fine Arts Studio provides hand-painted miniature artwork and customised watch-dial artwork as described on the applicable product page.

Unless expressly stated otherwise in writing, AMAANSA does not sell, manufacture, distribute, authenticate, service, repair, or resell the underlying watch.

Where a customer's watch or watch dial is used as the base for a commissioned artwork, the watch and its components remain the property of the customer or their respective owner. AMAANSA's service is limited to the agreed artistic work and the handling reasonably necessary to complete that work.

2. Third-Party Watch Brands, Trademarks and Intellectual Property

Any reference to a third-party watch brand, including but not limited to Casio, Rolex, Seiko, Citizen, Titan, Omega, or any other brand, is made solely for identification, compatibility, reference, or illustrative purposes.

AMAANSA Fine Arts Studio is not affiliated with, sponsored by, endorsed by, authorised by, or otherwise associated with any third-party watch brand unless expressly stated in writing.

AMAANSA does not claim ownership of any third-party trademarks, logos, brand names, watch designs, photographs, product imagery, trade dress, or other intellectual property belonging to their respective owners.

The appearance of a third-party watch, brand name, trademark, logo, or product image on the AMAANSA website or in promotional material must not be interpreted as an official collaboration, sponsorship, endorsement, partnership, authorisation, or association with the relevant brand.

3. Illustrative Watch Images

Any watch or watch image displayed on the AMAANSA website in connection with a watch-dial product may be used solely to demonstrate the appearance, scale, placement, compatibility reference, or potential presentation of the commissioned artwork.

Such images do not constitute an offer by AMAANSA to sell the underlying branded watch unless the product page expressly states otherwise.

The underlying watch shown in an illustrative image is not included with the commissioned artwork unless its inclusion is expressly stated on the applicable product page.

4. Customer-Supplied Watches or Watch Dials

Where a customer sends a watch or watch dial to AMAANSA, the customer represents that they are authorised to provide the item to AMAANSA for the commissioned work.

Customers acknowledge that a watch may have pre-existing scratches, dents, wear, mechanical or electronic issues, battery issues, movement issues, water-resistance issues, manufacturing defects, or other conditions that may exist before AMAANSA receives the item.

AMAANSA may photograph or otherwise document the condition of a customer-supplied watch or dial upon receipt for record-keeping purposes.

AMAANSA does not undertake general watch servicing, repair, restoration, polishing, authentication, battery replacement, waterproofing, pressure testing, or refurbishment unless a separate written agreement expressly provides for such service.

5. Underlying Watch and Components

The artistic service provided by AMAANSA does not constitute a warranty or guarantee for the underlying watch or any component of the watch.

Unless expressly agreed otherwise in writing, AMAANSA does not warrant or guarantee the condition, functionality, accuracy, durability, battery life, water resistance, manufacturer warranty, service eligibility, or future performance of the underlying watch or its components.

This includes, without limitation, the movement, battery, case, crystal, crown, hands, dial, dial feet, seals, gaskets, bracelet, strap, clasp, and other watch components.

This provision does not exclude or limit any liability that cannot lawfully be excluded or limited under applicable law.

6. Manufacturer's Warranty and Service Eligibility

Customers acknowledge that opening, modifying, replacing, removing, or otherwise handling a watch may affect the manufacturer's warranty, service eligibility, water-resistance rating, or other manufacturer specifications.

AMAANSA does not guarantee that any manufacturer's warranty or authorised-service eligibility will remain valid after the watch has been opened or modified for an artistic commission.

Customers who require continued manufacturer warranty or authorised-service eligibility should confirm the relevant manufacturer's requirements before commissioning the work.

7. Water Resistance

Opening or modifying a watch may affect its original water-resistance characteristics.

AMAANSA does not guarantee that a watch will retain or regain any water-resistance rating originally specified by its manufacturer following artistic modification or handling.

Customers should not rely solely on the manufacturer's original water-resistance rating after a watch has been opened or modified.

Where water resistance is important, customers should have the watch appropriately inspected and pressure-tested by a qualified watch professional after completion.

8. Compatibility

Where AMAANSA supplies a standalone painted watch dial intended for installation into a customer's watch, compatibility must be confirmed before the commission is accepted.

Visual similarity or matching diameter alone does not guarantee compatibility.

Compatibility may depend on factors including, but not limited to, dial dimensions, mounting points, dial feet, movement configuration, hand clearance, date-window position, thickness, case clearance, movement specifications, and other technical characteristics.

AMAANSA does not guarantee compatibility with a particular watch or movement unless such compatibility has been expressly confirmed by AMAANSA in writing.

Installation or fitting of a watch dial should be carried out by a qualified watchmaker or appropriately trained professional.

9. Customer-Supplied Photographs and Reference Material

The customer represents that they have the necessary rights, permissions, or authorisation to provide photographs, images, logos, or other reference materials supplied to AMAANSA for the commissioned artwork.

The customer remains responsible for ensuring that materials supplied by them do not infringe the copyright, trademark, privacy, publicity, or other rights of any third party.

AMAANSA may decline to use any reference material where it reasonably believes that its use may create legal, intellectual-property, or other compliance concerns.

10. Transit and Handling of Customer-Supplied Watches

If a customer sends their own watch or watch dial to AMAANSA, the customer is responsible for appropriate packaging and for any loss or damage occurring before the item is received by AMAANSA, subject to applicable law.

Customers are responsible for ensuring that valuable watches are appropriately insured during transit where such insurance is available and desired.

Upon receipt, AMAANSA may document the condition of the item before commencing work.

After completion, AMAANSA will use reasonable care to package the commissioned item before handing it to the designated shipping carrier.

Once the completed item has been handed to the carrier, delivery, carrier handling, customs clearance, delays, loss, or damage may be affected by circumstances outside AMAANSA's reasonable control.

Customers must retain all packaging and shipping documentation and promptly notify AMAANSA if damage is observed upon delivery.

Nothing in this section excludes or limits any liability that cannot legally be excluded or limited.

11. No Implied Brand Association

The creation of customised artwork for use with a particular watch does not create, imply, or represent any relationship between AMAANSA Fine Arts Studio and the manufacturer, distributor, owner, or authorised representative of that watch brand.

References to brand names may be used where reasonably necessary to identify a referenced product or describe compatibility, but such references do not constitute an endorsement, affiliation, authorisation, partnership, sponsorship, or collaboration.

12. Watch Condition Documentation

For customer-supplied watches, AMAANSA may photograph or record the item's visible condition and identifying characteristics before commencing work.

Such documentation may include photographs of the case, crystal, crown, caseback, bracelet or strap, clasp, dial, hands, reference number, serial number where appropriate, and visible pre-existing marks or damage.

The purpose of such documentation is to establish the observable condition of the item when received and is not an independent authentication, valuation, appraisal, or mechanical inspection.

13. Limitation Applicable to Watch-Dial Services

To the extent permitted by applicable law, AMAANSA's contractual responsibility in connection with a watch-dial commission is limited to the artistic service expressly agreed with the customer.

AMAANSA shall not be responsible for indirect, incidental, special, or consequential losses arising from the condition, malfunction, deterioration, manufacturer's warranty status, or performance of an underlying third-party watch or its components, except to the extent such liability cannot lawfully be excluded or limited.

Nothing in these Watch Dial Commission Terms excludes or limits liability that cannot legally be excluded or limited under applicable law.

 

Reference material and source verification

Acceptable Reference Materials:

  • Personal photographs taken by or belonging to the client

  • Public domain images with verified status

  • Properly licensed stock photography or artwork

  • Original artistic works created by the client

Prohibited Reference Materials:

  • Copyrighted images downloaded from Pinterest, Instagram, or other social platforms without permission

  • Professional photographs or artworks without proper licensing

  • Images where copyright ownership cannot be verified

  • Materials that may infringe third-party intellectual property rights

Shipping Terms

AMAANSA Fine Arts Studio takes reasonable care in preparing and packaging orders before handing them to the designated shipping carrier.

Once a parcel has been handed over to the shipping carrier, delivery time, carrier handling, customs processing, delays, loss, or damage may be affected by circumstances outside AMAANSA's reasonable control.

For parcels reported as missing or materially damaged, customers should notify AMAANSA as soon as reasonably possible and provide the relevant tracking information, photographs, packaging photographs, and any other documentation requested by AMAANSA so that the matter can be investigated with the carrier.

Any replacement, repair, or refund relating to carrier loss or damage will be handled in accordance with AMAANSA's applicable Refund Policy, the terms of the shipping carrier, and applicable law.

Customers are responsible for providing accurate shipping and billing information.

For international orders, customers are responsible for applicable import duties, taxes, customs charges, brokerage charges, and other destination-country charges unless expressly stated otherwise on the applicable product page or at checkout.

Customs clearance, inspection, import restrictions, delays, or refusal of entry may affect delivery timelines and are outside AMAANSA's reasonable control.

Nothing in these Shipping Terms excludes or limits any liability or consumer right that cannot legally be excluded or limited.
